Key Issues in Hate Speech Prosecutions and Use of Hate Speech at Criminal Trial

This program will explore recent United States and New Jersey Supreme Court cases that have addressed issues involving so-called hate speech in the context of criminal prosecutions. In particular, the cases help define the contours of answers to questions such as, when is hate speech a crime? When is hate speech admissible in a case involving other crimes? What are the strategic and ethical considerations involved in deciding whether to seek to use hate speech evidence?
Experienced judges and attorneys will explore these and related issues using the recent United States Supreme Court decision in U.S. v. Elonis, and decisions of the New Jersey Supreme Court in State v. Skinner, and State v. Pomianek. This is sure to be an informative and lively discussion.

This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 2.4 hours of total CLE credit. Of these, 1.2 qualify as hours of credit for ethics/professionalism.
