Implicit Bias in the Legal Profession

This program will discuss implicit bias and how it manifests in the legal profession. Attendees will discover the science behind implicit bias, explore the implications of implicit bias for the practice of law and the administration of justice, and identify practical techniques for overcoming the operation of implicit bias in their daily practice and in the profession. Topics include:

- The emerging data and research in the field of cognitive psychology on implicit bias.
- How implicit bias operates in the legal profession, including in interactions with clients, colleagues, and the judicial system, and how these interactions can create or reinforce systemic disparities in the legal profession and in the justice system.
- The ethical implications of implicit bias as viewed through the lens of New Jersey's Rule of Professional Conduct 8.4(g).
- Practical approaches, based on cognitive and behavioral interventions, for addressing implicit bias in the legal profession to increase effectiveness in the practice of law and contribute to professional and ethical conduct.

NJ CLE Information: This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 1.8 hours of total CLE credit including 1.2 hours of ethics.
