Introduction to Civil Trial Preparation

This program will provide an overview of basic civil litigation practices and techniques for new attorneys. The course will cover the nuts and bolts of pre-trial litigation in both the Federal and State Courts of New Jersey, including:
• Case evaluation, engagement budgets and client relations;
• Pre-Suit proceedings, including – investigation, witness interviews and evidence preservation;
• Pleadings – drafting techniques and pleading strategies;
• Discovery - scope and privilege issues; Rule 26 Disclosures; Best Practices; case management; discovery of electronically stored information; effective use of interrogatories and document requests; deposition procedures, strategies and techniques; requests for admission; independent medical examinations and non-party discovery;
• Experts – role of experts; finding and retaining experts; preparation of reports; discovery issues; and admissibility of expert opinion testimony;
• Motions – strategies, procedures and standards for motions directed to pleadings, discovery and dispositive issues; brief writing and oral argument; and
• Final trial preparation – pre-trial exchanges/submissions; pre-trial conferences and motions in limine

Mr. Gardner has been representing clients in the federal and state courts for more than thirty years in complex commercial, construction and environmental litigation, class actions, product liability claims and mass tort actions. He is also an adjunct professor at Rutgers Law School teaching Civil Litigation Strategy and Practice, and has served six terms as a member of the Supreme Court’s Civil Practice Committee.
