The Patent Process: What Non-IP Lawyers Need to Know

Learn how an idea or invention moves through the U.S. Patent and Trademark Office to become a patent. Understanding the process will help you counsel clients who receive a cease and desist letter, inherit a patent, defend against a patent holder, or evaluate whether buying or licensing a patent is a good investment. The program will help you to:
• Define what a patent is and what materials are included in a patent
• Identify different types of patents and patent applications
• Describe the pathway from invention to a patent in both the United States and foreign countries
• Adhere to the statutory requirements for obtaining a patent in the U.S.
• Evaluate the relative strength of a patent
• Recognize the importance of non-disclosure agreements throughout the process
• Anticipate the pitfalls of working with invention companies

NJ CLE Information: This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 1.5 hours of total CLE credit.

Pat Werschulz is a registered patent attorney who is in the job of protection. She works with inventors and start-ups to protect their valuable inventions and brands. Before going to law school, she was a Director of Research and Development for Bristol-Myers Squibb Consumer Medicines where she learned what it takes to take an invention from lab to marketplace. After more than 30 years as a chemist, she decided to change to law and is a 2009 Rutgers Law graduate.
