Criminalizing Sex: A Unified Liberal Theory

This program explores the law of sexual offenses and the implications of the divergence between more punitive laws for nonconsensual sex and more permissive laws for consensual sex. The discussion includes the role of criminal law and the conflict in practice to adequately protect individuals in their right not to be subjected to sexual contact against their will, while also safeguarding their right to engage in private sexual conduct in which they do wish to participate. The program recognizes the current cultural context – such as the #MeToo movement and the ongoing revision of the American Law Institute’s Model Penal Code – and includes special reference to the codification of sexual offenses under New Jersey law.

Professor Green’s work explores the underlying moral content of criminal law and is especially concerned with the question of criminalization. This presentation is based on his newly-published book, Criminalizing Sex: A Unified Liberal Theory.
