Petitions for Post-Conviction Relief (PCR) are one of the most necessary but least understood parts of criminal practice. A successful PCR results in a new trial, but, is that always what someone is looking for? Are PCRs the same as motions to set aside pleas or mistrial motions? How can a PCR help my clients? The purpose of this CLE is to briefly discuss what PCRs are, what they are NOT, when they can be helpful and when they can hurt. This will include a discussion of how clients and attorneys go about filing for a PCR and the process once one is successfully filed.
